The intent of this policy document is to provide for a clear understanding of our expectations of clients with regards to acceptable and unacceptable uses of our service offering. The Internet community trusts and values individuals and organizations which abide by generally accepted legal and "good sense" guidelines. Those which do not follow these rules bring mistrust of themselves and often generate large volumes of complaints if not lawsuits.
NOCservices is not in the business of censoring content, nor do we wish to be. While we believe in free speech, there are limits to the "speech" which may take place via our services. These limits generally fall into two classes: legal limits and courtesy limits. Both are discussed below.
Our clients may not engage in illegal activities using our services. Legality is determined by the laws of the State of New Jersey and the United States of America. Examples include, but are not limited to:
When speaking of "courtesy limits," we refer to limits on actions which disrupt the ability of any person or organization to legitimately use computer or network resources. Examples include, but are not limited to:
NOCservices does not, and cannot, monitor all of the communications, files and activities of our clients and relies on each to take those steps appropriate to ensure that their use, and use by their users (employees, clients, etc.) do not violate these rules and applicable laws. For purposes of system maintenance, including backup, upgrades and troubleshooting, as well as to investigate complaints of abuse, NOCservices reserves the right to inspect all uses of its services. Outside persons and organizations will not be given access to client data unless acting on behalf of NOCservices, given permission by the client involved or by order of a court with jurisdiction over our operations.
Complaints of AUP violations should be accompanied by as much detailed information as possible, including (if possible) a copy of the message in question with all headers intact, and sent to abuse@nocservices.com or via the postal services marked "Abuse Report." Questions about this policy may also be sent to this address.
